Groovy Fox is a brand name of ASE Project AD, a company registered in the Bulgarian Company Registry with a VAT number BG202722291 and address of operations 1606 Sofia, 5 Predel str. represented by its Executive director – Georgi Evgeniev.
The present Terms and Conditions consider the aspects of distant selling and buying of goods as defined in the Consumer Protection Act of Bulgaria and settle the relations between the above mentioned legal entity – ASE Project AD, referred to as the SELLER and the person/s that has agreed with the following Terms and Conditions, referred to as the BUYER.
Shipment
The Buyer bears the full risk of any damage or loss of goods during delivery. As soon as the Seller hands over the goods to a courier company, the Seller is relieved of the risk and it is transferred to the Buyer.
The goods should be carefully inspected by the Buyer upon delivery. Any damages should be reported to the Seller immediately. In the event that damages are found to have occurred during the transportation of the goods, the Seller is not responsible for the warranty service of this product. In the case of incorrect or misspelled address, contact person and/or telephone number when submitting the order, the Seller is not bound by any obligation to fulfill the order.
When the goods are handed over, the Buyer or a third person signs the accompanying documents. A third person is considered to be any person who is not the Buyer but is at the address specified by the Buyer and accepts the goods upon delivery.
In the event that the Buyer is not found within the delivery period at the specified address or if there is no access to the address and conditions for the delivery of the goods to happen within this period, the Seller is relieved of his responsibility to deliver the goods ordered by the Buyer.
Upon refusal to receive the goods, the refusal shall be considered unfounded, except in the case described below, and the Buyer shall cover the costs of return and delivery of the goods to the Seller.
When the delivered goods apparently do not correspond to the goods ordered by the Buyer and this can be established through its regular review, the Buyer may request that the goods be replaced by a corresponding purchase request made within 24 hours of receipt.
The delivery is made by Standard Shipping using courier and postal services. Delivery costs for different regions are calculated according to the price list of the shipping companies we use to make our shipments. The shipping costs below apply only for the purchase of shoes. In case an accessory is purchased only, the shipping costs will be calculated on the base of its weight and the sum will be displayed upon checkout.

Standard Shipping within Europe is usually made in 4-5 working days after your order has been placed and payment has been received. Deliveries outside of Europe may take up to 14 working days depending on the location of delivery. These delivery times are indicative. The Seller is not responsible for delays in delivery if the delay is due to a courier or other supplier.
The buyer shall cover any additional customs duties and taxes associated with the import of their order.
Payment
The prices set on our website include packaging and VAT. The cost of delivery is calculated upon checkout.
We accept Visa and MasterCard, and any other methods which may be supported by Paysera.
Upon checkout, you may be redirected to Paysera website to review and complete your payment. Once your transaction is complete, you will then return to our website. Before the dispatch of goods, your payment must be debited and cleared from your account. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to the seller, we will not be liable for any delay or non-delivery.
We take substantial care to make our Site secure. All credit/debit card transactions on this site are processed by Paysera, a secure online payment gateway that encrypts your card details in a secure host environment. In addition, to help ensure that your shopping experience is safe, simple, and secure, we use Secure Socket Layer (SSL) technology.
Furthermore, we do all our best to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.
We also provide the option to place a payment with your credit/debit card using your PayPal account.
You can also choose to pay by direct bank transfer using our bank details provided upon checkout. In this case, the items will be processed and dispatched once we have received the payment into our bank account. The payment must be credited into our bank account within 10 working days of placing your order. During that period your order will be placed on hold. If the payment is not received within the specified time period, your order will be canceled.
Gift Card vouchers, discount coupons and prizes
Gift Card vouchers are valid for a period of 3 months from the date of purchase. Gift Card vouchers and items purchased through Gift Card vouchers cannot be refunded.
Discount coupons cannot be used in conjunction with other coupons or applied to items on sale.
Prizes from competitions, sweepstakes, giveaways, commercial and donation-based campaigns or promotions shall be claimed within a period of 3 months from the date of announcement of the receiver. After this period, the right of receipt of the prize expires. Prizes cannot be returned for a refund.
Instructions on how to use and care for your new shoes
Like all natural products and materials, natural leather has the ability to breathe and change over time, as well as to loosen due to prolonged wearing. Give your new shoes a chance and they will take on the shape of your feet.
Use your shoes as intended, given that in order to extend the life of natural materials from which the sole is produced, it is not advisable to wear the shoes on wet, uneven and rough surfaces.
We recommend that you do not wet your shoes. If the shoes get wet, do not dry them in the immediate vicinity of a stove or radiator but at room temperature as exposure to heating appliances causes skin cracking and sticking.
Do not wash your shoes in a washing machine.
It is recommended that after wearing the shoes you leave them to “breathe” for at least 24 hours to allow the skin to dry out of the moisture absorbed. This way the shoes are protected from deformation and you extend their life.
Guarantee
The buyer has the right to use the legal guarantee provided by the Bulgarian legislation, in particular the Consumer Protection Act for conformity of the purchased products with the contract of sale.
In the case of a lack of conformity of the product with the sales contract, the buyer is entitled to address a complaint, requesting the seller to bring the product into conformity with the sales contract. In such case, the buyer may choose either repair or replacement of the product, unless this is impossible or the remedy chosen by the buyer is disproportionate in comparison with the other remedy. A remedy is disproportionate if it imposes costs on the seller which, in comparison with the alternative remedy, are unreasonable, taking into account:
1. the value that the consumer goods would have if there were no lack of conformity;
2. the significance of the lack of conformity;
3. whether an alternative remedy could be offered to the consumer without significant inconvenience thereto.
Where the products are not in conformity with the sales contract, the seller shall be obligated to bring the said goods in conformity with the sales contract within one month after the date on which the complaint was addressed by the consumer. Upon expiry of this time limit, the buyer is entitled to have the sales contract rescinded and to reimbursement of the sums paid or to have a reduction made in the price of the product.
The product is brought into conformity with the sales contract free of charge for the buyer. The buyer is not liable for any costs incurred for the dispatch of the product or its repair. The buyer may furthermore seek compensation for damage resulting from the lack of conformity.
Where the buyer is not satisfied with the settlement of the complaint, the buyer is entitled to choose between one of the following options:
1. rescission of the contract and reimbursement of the sum paid thereby;
2. reduction of the price.
The buyer is not entitled to claim reimbursement of the sum paid or reduction of the price of the product where the seller agrees to a replacement of the product with a new one or to repair it within one month after the complaint was addressed by the buyer.
The seller is obligated to satisfy a claim for the rescission of the contract and to reimburse the sum paid by the buyer where, after satisfying three complaints by the buyer by carrying out repairs of one and the same product, the product yet again does not conform to the sales contract.
The buyer is not entitled to claim rescission of the contract if the lack of conformity of the consumer goods with the contract is minor.
A complaint may be addressed to the buyer in writing using the contact details written on the “Contact” section of the website. The buyer has to specify the purpose of the complaint, the manner of satisfaction of the complaint preferred, respectively, the amount of the sum claimed, and contact address. Upon submission of a complaint, the buyer must attach the documents supporting the complaint – documents establishing the grounds and amount of the claim.
Complaints may be addressed within two years after the time of delivery of the product but not later than two months after establishment of the lack of conformity with what has been agreed. This period is interrupted during the time needed to repair or replace the product or to reach a settlement of the dispute between the seller and the buyer.
When the seller satisfies a complaint, the seller has to issue a statement on it, which has to be drawn up in duplicate, and a copy must be provided to the buyer.
Claims are not considered reasonable in case the above-mentioned instructions for use are not followed as well as for damages and defects resulting from improper use and maintenance or caused intentionally, or due to excessive wear and normal wear out.
Every effort to display the colors of the products that appear on the website as accurately as possible is made. However, as computer monitors, tablets and mobile devices vary, there is no guarantee that the buyer’s monitor’s display of a color will be completely accurate.
